U.S. State Privacy Notice

This U.S. State Privacy Notice supplements our Privacy Policy and applies to residents of California and of other U.S. states with comprehensive consumer privacy laws (including Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah and Virginia) (“U.S. State Privacy Laws”). Terms such as “personal information”, “sale”, “share” and “targeted advertising” have the meanings given in those laws.

1. Personal information we collect

In the past 12 months we may have collected the following categories of personal information, from the sources and for the purposes described in Sections 2 and 3 of our Privacy Policy:

We do not collect sensitive personal information as defined by U.S. State Privacy Laws, and we do not use or disclose personal information for purposes that would give rise to a right to limit.

2. “Sales”, “sharing” and targeted advertising

We do not sell personal information for money. However, where our free products show ads, disclosing identifiers, network activity and approximate geolocation to advertising and measurement partners may be considered a “sale”, “sharing” for cross-context behavioural advertising, or processing for “targeted advertising” under U.S. State Privacy Laws.

How to opt out:

• use the “Do Not Sell or Share My Personal Information” or privacy option in the app’s settings, where available;
• turn off tracking (iOS: Settings → Privacy & Security → Tracking) or delete your advertising ID / opt out of ads personalisation (Android: Settings → Google → Ads); or
• email hey@lanista.vc with the subject “Do Not Sell or Share” and the name of the app and your player ID.

We honour opt-out preference signals such as Global Privacy Control where they are technically received by our Services. We do not knowingly sell or share personal information of consumers under 16 years of age.

3. Your rights

Subject to the laws of your state, you have the right to:

• Know / access the personal information we have collected about you, including the categories, sources, purposes and recipients, and to obtain a copy in a portable format;
• Delete personal information we have collected from you;
• Correct inaccurate personal information;
• Opt out of the sale or sharing of personal information, targeted advertising and profiling in furtherance of decisions with legal or similarly significant effects (we do not engage in such profiling); and
• Non-discrimination — we will not discriminate against you for exercising your rights.

4. How to submit a request

Email hey@lanista.vc with the subject line “U.S. Privacy Request”, stating your state of residence, the right you wish to exercise, the name of the app and your in-app player ID. We will verify your request by matching the information you provide with information in our records, and respond within 45 days (which may be extended by a further 45 days where permitted by law).

Authorised agents: you may use an authorised agent to submit a request on your behalf. We may require proof of the agent’s authority and ask you to verify your identity directly with us.

Appeals: if we decline to take action on your request, you may appeal by replying to our decision or emailing hey@lanista.vc with the subject “Privacy Appeal” within a reasonable period. We will respond within the time required by your state’s law. If your appeal is denied, you may contact your state Attorney General.

5. Retention

We retain each category of personal information for the periods described in Section 6 of our Privacy Policy.
